These terms govern your use of the Warburton service and the iamwarburton.com website, operated by Costwolds LLC.

Agreement to terms

By accessing the iamwarburton.com website or using the Warburton service, you agree to be bound by these terms. If you do not agree to these terms, do not use the service.

“Service” refers to the Warburton Community Operating System, including all moderation, safeguarding, governance, knowledge capture, and related features provided through Telegram, Discord, and WhatsApp integrations.

“We”, “us”, and “our” refer to Costwolds LLC. “You” and “your” refer to the individual or entity subscribing to or using the Service.

Service description

Warburton is a Community Operating System that provides AI-powered community management, moderation, safeguarding, knowledge capture, and operational intelligence for online communities on Telegram, Discord, and WhatsApp. The Service includes a 14-day free pilot period, after which a paid subscription is required for continued use.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.

Accounts and subscriptions

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when subscribing to the Service.

Subscription fees are billed monthly at the rate in effect at the time of billing. Current pricing is available on request. We will provide at least 30 days’ notice before any price increase takes effect for existing subscribers.

As a community operator using Warburton, you are responsible for:

Intellectual property

The Service, including its software, design, character voice, documentation, and all related intellectual property, is owned by Costwolds LLC and protected by applicable intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for your community during the subscription period.

You retain ownership of your community content. By using the Service, you grant us a limited licence to process your community messages as necessary to provide the Service.

Data and privacy

Our collection and use of information is described in our Privacy Policy. By using the Service, you agree to the data practices described therein.

Limitation of liability

To the maximum extent permitted by law, Costwolds LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

The Service includes safeguarding and welfare features, but it is not a substitute for professional crisis intervention, law enforcement, or mental health services. We do not guarantee that all harmful content will be detected or that all welfare concerns will be identified.

Disclaimer of warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that all harmful content in your community will be detected.

Termination

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

We may terminate or suspend your access to the Service immediately if you breach these terms. Upon termination, your right to use the Service ceases. Provisions that by their nature should survive termination (including limitation of liability, intellectual property, and governing law) will survive.

Email communications

We may send you service-related communications by email, including operational updates, billing notifications, security alerts, and onboarding information. Inbound emails related to the Service are processed through our Gmail filter (Warburton_Gmail_Filter) to ensure timely triage and response. By contacting us via email you acknowledge that your correspondence may be filtered, labelled, and retained in accordance with our Privacy Policy.

Governing law and jurisdiction

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these terms or the Service shall be resolved in the courts located in Delaware.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated through the website or via email to active subscribers with at least 30 days’ notice. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
